The National Credit Act gives every borrower in South Africa a set of protections, from the right to clear pre-agreement disclosure to the right to settle early without penalty. This section explains those rights in plain language — what a lender must tell you, what they may and may not do, and where to turn if something goes wrong. Knowing your rights helps you hold any credit provider to account and recognise when an offer or a collection practice falls short of the law.

NCA Rights — common questions

What must a lender disclose before I sign?

Under the National Credit Act, a registered credit provider must give you a pre-agreement statement and quotation showing the interest rate, all fees, the instalment and the total cost of credit before you commit.

Can I settle my loan early?

Yes. The National Credit Act allows you to settle a credit agreement at any time by paying the outstanding balance plus interest and fees up to the settlement date, with no early-settlement penalty.

What can I do if I cannot pay?

Contact your credit provider early to discuss an arrangement, and consider debt counselling if you are over-indebted. The Act provides processes designed to help consumers in difficulty rather than penalise them.
